Terms of Service

1. Agreement to Terms

Welcome to Savr! These Terms of Service ("Terms") are a binding legal agreement between you and Savr ("we," "us," or "our") that governs your use of the Savr mobile application and our related services (collectively, the "Service").

By using our Service, you agree that you have read, understood, and consented to these Terms. If you do not agree with these Terms, you should not use the Service.

2. The Service

Savr provides a platform that connects users ("Users" or "Consumers") with restaurants, bakeries, cafes, and other food vendors ("Vendors") to facilitate the sale of surplus food items ("Products"). Savr is a marketplace provider and is not responsible for the preparation, quality, safety, or delivery of the Products. The contract for sale of Products is directly between the User and the Vendor.

We do not guarantee that any Vendor will have surplus Products available on any given day, nor do we guarantee the contents of any "Surprise Bag" or "Savr Pack". The nature of the Service is that the available Products are unpredictable.

3. User Accounts

To use most features of the Service, you must register for an account. When you register, you agree to: (a) provide accurate, current, and complete account information; (b) maintain the security of your password and not disclose it to any third party; and (c) accept all risks of unauthorized access to your account. You are responsible for all activities that occur under your account.

4. Purchases and Payments

By purchasing a Product through the Service, you agree to pay the listed price. All payments are processed through third-party payment gateways. We do not store or handle your payment card information.

It is your responsibility to collect your purchased Product from the Vendor at the specified location and within the specified pickup window. If you fail to pick up your Product within the designated time, your order will be cancelled, and you will not be eligible for a refund. This policy is in place because the Products are perishable and cannot be held for you.

5. Vendor Responsibilities

Vendors who use the Service agree to: (a) provide accurate and honest descriptions of their Products; (b) ensure that all Products sold are safe for consumption and comply with all applicable food safety laws and regulations; (c) honor all sales at the price listed; and (d) treat all Users with respect.

6. Prohibited Activities

You may not access or use the Service for any purpose other than that for which we make the Service available. As a user, you agree not to:

• Use the Service to engage in any fraudulent, illegal, or harmful activity.
• Resell Products purchased through the Service for commercial purposes.
• Infringe upon the intellectual property rights of Savr or any third party.
• Harass, abuse, or harm another person using information obtained from the Service.
• Circumvent, disable, or otherwise interfere with security-related features of the Service.

7. Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Savr, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property or proprietary rights laws. You are granted a limited license to use the Service for personal, non-commercial use only.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including a breach of these Terms. If you wish to terminate your account, you may simply discontinue using the Service or use the account deletion feature within the app.

9. Disclaimers and Limitation of Liability

Please read this section carefully as it limits our liability. The Service is provided on an "as is" and "as available" basis. While we strive to provide a great experience, we make no warranties, express or implied, regarding the Service or the Products, including the quality, safety, or legality of Products sold by Vendors.

To the fullest extent permitted by law, Savr shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, arising from your use of the Service or for any dispute between you and a Vendor.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Uzbekistan, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Uzbekistan for the purpose of litigating all such claims or disputes.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
